The injunction against Layton’s leaving the country has been lifted. Layton remains in custody with existing criminal charges still pending against him. The Director of Public Prosecutions informed the Embassy November 10 that he was prepared to proceed with submission of a “nole prosequi\u201d notice and, in cooperation with the Chief Immigration Officer, to expel Layton at a time convenient to the USG [United States Government]. He said he could now foresee nothing of a legal nature that would interfere with this plan. On the basis of the DPP’s assurances, we agreed that Layton should be placed on the November 14 Guyana Airways (GAC) flight for Miami and that USG official should be present to escort him back.<\/p>\n 2. We intend to confirm flight arrangements with GAC later this week, utilizing three of the seats reserved for US Attorney Hunter’s party on the November 14 flight. FBI San Francisco should not repeat not cancel these reservations.<\/p>\n 3. We continue to have some doubts that all will go according to plan on November 14. There is no guarantee that Layton’s lawyers here will not think of some new device to prevent his departure. In addition, the Chief Immigration Officer has refused an informal request by Emboff [Embassy officer] for a meeting to discuss details for November 14. However, on the basis of DPP [Emanuel] Ramao\u2019s assurances, Embassy believes we must proceed on the assumption that Layton will be expelled as is now planned. Consequently, we recommend that FBI Special Agent [Donald Hale<\/span>] make the necessary arrangements to accompany Layton to the US the morning of November 14.<\/p>\n 4.
