On December 6, 1983, United States Court of Appeals for the Ninth Circuit denied defense petition for rehearing.<\/p>\n
On same date, defense for Larry Layton filed a motion for stay of mandate until such time as they could appeal the Ninth Circuit opinion before the Supreme Court.<\/p>\n
It is expected that the Ninth Circuit will grant the defense state of mandate to enable them to appeal matter before Supreme Court.<\/p>\n
