William Sheldon Oliver is their son born to them on December 25, 1959. (See exhibit “A”)

2. The above-named child, a minor, resided with petitioners until or about July 26, 1977, at which time the petitioners granted to the Peoples Temple, their agents, employees and corporate officers and their Pastor, Reverend James Jones Power of Attorney to remove said child from the petitioners’ possession for a temporary period subject to the desires of petitioners. (See exhibit “B” – a copy of the Power of Attorney.)

3. The petitioners’ son, William Sheldon Oliver is in the possession of the respondents.

4. On or about October 17, 1977, the petitioners revoked the said Power of Attorney by mailing a copy of the revocation to the corporate office and establishment of the

—–

NN-4-K5

Peoples Temple located at 1859 Geary Blvd., San Francisco and their attorney Charles Garry at 1256 Market St., San Francisco and attorney Eugene B. Pursuant to the said revocation, the Peoples Temple, their agents, employees and corporate officers and their Pastor, Reverend James Jones had until October 22, 1977 to return petitioners’ son, William Sheldon Oliver back to the petitioners. As of today, the respondents have failed to release petitioners’ son from their illegal confinement and detention. In fact, respondent attorney Charles Garry, has told the petitioners and their attorney that they will not comply with the petitioners’ demand.

6. The petitioners’ son, William Sheldon Oliver, is now being held against the will and desires of his natural parents, the petitioners. The petitioners have it on information and belief that their child is now being confined, detained and restrained in the country of Guyana.
7. Said confinement and detention constitutes an illegal detention and confinement against the legal authority vested in the natural parents, the petitioners.
8. The petitioners have it on information and belief that the respondents are physically abusing and mentally tormenting their son, William Sheldon Oliver.
9. The above-named child has not been committed, detained , nor his custody determined in any way whatsoever by virtue of any judgment, decree, order or award of any kind by any court or other competent tribunal.
10. Petitioners are fit and proper parents and custodian for the above-named child, and petitioners have not abandoned

—–

NN-4-K6

their child. The Power of Attorney granted to the above-named respondents was for a temporary period subject to the desires of the petitioners.

11. The petitioners have on numerous occasions made written and verbal demands to the respondents to return their child. All the demands made by the petitioners have been callously disregarded by the respondents.

12. The respondents in this matter have no legal right to possession of petitioners’ minor child.

13. Petitioners have no other plain, speedy or adequate remedy at law.

14. Agency not coupled with an interest; bona fide transaction without knowledge of termination; power of attorney.

Unless the power of an agent is coupled with an interest in the subject of the agency, it is terminated by: (1) Its revocation by the principal.

In this matter the petitioners granted to the respondents a power of attorney over their minor son, William Sheldon Oliver on or about July 26, 1977. Pursuant to this power of attorney, the respondents removed petitioners’ son from the State of Calif.

—–

NN-4-K12

to the country of Guyana. On October 17, 1977, the petitioners revoked the above power of attorney by notifying the Peoples Temple, at 1859 Geary Blvd, San Francisco and their attorney and spokesman, Charles Garry, by registered letter of this revocation.

As it states in Becket v. Welton and Associates 39 C.A.3d 815, 821, a. power of attorney not coupled with an interest is terminated at the will of the principal for any reason by notifying the agent. The same principle is enunciated in Synder v. Westoner 217 F.2d 928; A power of attorney is revocable at will by either party even if it is stated that it was irrevocable, when the power of attorney is not coupled with an interest.

It is clear from the facts in our case that the power of attorney agreement granted to the Peoples Temple was not coupled with an interest, because the agents did not possess an interest in the subject, petitioners’ son. Therefore, the notice given on October 17, 1977, by the petitioners to the Peoples Temple terminated the power of attorney created on July 26, 1977. The refusal by the Peoples Temple to deliver petitioners’ son to them constitutes an illegal confinement and restraint by the Peoples Temple of William Sheldon Oliver.

II

NATURAL PARENTS ENTITLED TO PHYSICAL CUSTODY OF A CHILD CAN ENFORCE
THAT RIGHT AGAINST A PERSON OR ENTITY WRONGFULLY WITHHOLDING
THEIR CHILD BY A PETITION FOR A WRIT OF HABEAS CORPUS.

It is well established by law that a parent can utilize a Writ of Habeas Corpus against one who is wrongfully withholding their child.as stated in In Re Richard 537 P.2d 363.

—–

NN-4-K13

“Habeas corpus is the proper procedure to release an infant from all manner of illegal restraint and to determine matters of custody. Thus, the writ is available to determine whether one who has custody without authority of legal proceedings is entitled to such custody and to release the child if the restraint is found to be unlawful; and the writ will lie even though such person not longer has custody, if he has secredted the infant in anticipation of the writ, and it appears that the child may be produced. If custody has been awarded by a decree of a competent tribunal the writ is available to compel the delivery of the child to the one declared entitled to judgments of sister states in this regard be recognized.” Rose v. Superior Court 194 P.2d.568.

Therefore, predicated on the above points and authorities and the verified petition, the court should issue a Writ of Habeas Corpus in this matter for the wrongful withholding of petitioners’ son by the Peoples Temple.

Respectfully submitted by,
/s/ Roger C.
