Re: San Francisco teletype to Bureau dated January 8, 1982.

On January 12, 1982, Chief Judge Robert F. Peckham, US District Court, San Francisco, California, formally denied US government motions re evidentiary matters. On January 13, 1982, in US District Court, trial date was set for February 2, 1982 to commence selection of jury.

It is anticipated that the United States Attorney’s office will appeal judge’s denial of US government’s evidence motions

before Ninth Circuit US Court of Appeals prior to trial date. At the time of filing of appeal, trial date set would automatically be vacated for indefinite period of time, until Court of Appeals makes final judgment.

For information of State Department and American Embassy Georgetown a more realistic trial date would be March or April if not later.

Bureau is requested to relay to US State Department; Bureau of Consular Affairs, CA/SI/CCS/ARA, attention: [name deleted].
