Embassy is puzzled by instructions Ref A in view of the fact a court decision is pending regarding the custody of John Stoen, and the Department’s previous instructions contained in Para 4 of Ref B, i.e., “Consular officer should require proof of custody if a person other than parent claims to have sole custody of minor.”

Department will recall that, in addition to John Stoen’s original passport which is in custody of his People’s Temple guardian, Embassy issued a temporary emergency passport (now [illegible word]) for John Stoen after Grace Stoen’s presented California court order giving custody of John to his mother in an affidavit executed by her giving the attorney power in loco parentis specifically for passport purposes (Ref C). Since the custody case of John Stoen is still pending court decision in Guyana, Embassy believes that the

issuance of passport to “anyone” having [illegible word] custody of John Stoen to facilitate his removal from the court’s jurisdiction could be interpreted as [illegible word] complicity and kidnapping.
