Resftel to Bureau, December 13, 1978.

Referenced communications advises Chief Federal Judge Robert Peckham, NDC [Northern District of California], ordered that FD-302’s regarding interviews of certain People’s Temple (PT) members be turned over to witness attorneys by December 22, 1978.

On this date, AUSA Richard Brewster, Chief Criminal Division, EDNY [Eastern District of New York], advised that this is preposterous, and witness attorneys not entitled to interviews. AUSA Brewster advised the name of the individuals interviewed have been formally charged and have been subpoenaed as witnesses. AUSA Brewster advised that action to bar surrender of interviews. Would have to occur at San Francisco.

PAGE TWO UNCLAS

San Francisco advise BQMRA if any such legal action is contemplated prior to surrender of interviews.
