1. Legatt at Caracas has requested that Embassy obtain various records and documents sought by Civil and Criminal Division, Department of Justice, in connection with continuing investigation of Peoples Temple. Embassy has deferred response to Legatt pending confirmation of status of this material under Privacy Act.

2. Embassy is advised that Justice has formally advised Department of the initiation of an investigation of the Peoples Temple. Embassy believes that any documents or information requested by Justice in connection with this investigation would be exempt from prohibitions against disclosure contained in Privacy Act. Embassy requests Department confirmation of this view. Material requested by Legatt, Caracas will be requested from GOG [Government of Guyana] when confirmation received.
