For information of the Bureau, on January 5, 1981, Layton defense filed notice of motion to dismiss indictment on jurisdictional grounds. Hearing set for February 20, 1981, to hear this as well as other motions. On February 20, 1981, Presiding Judge Robert Peckham, US District Court, Northern District of California, arguments and supporting briefs and stated he would take matter under consideration and a ruling would be forthcoming.
On February 25, 1981, Judge issued a decision in favor of government that extraterritorial jurisdiction does exist on all four counts of the indictment, Title 18, US Code, Sections 351 (a), 351 (b), 116 (a), 1117-2.
