As previously reported, government filed appeal in captioned matter (US v. Layton, CR 80-0416 RFP) on February 1, 1982, in US Court of Appeals, Ninth District, San Francisco, California concerning evidentiary matters denied by the trial judge Robert F. Peckham.

Appellate schedule is now set: On March 17, 1982 trial transcripts will be filed. On April 7, 1982 government briefs will be served and filed. On April 28, 1982 defendant brief is to be filed. On May 5, 1982, government’s reply to defendant’s brief will be filed. Thereafter bait for oral arguments will be set normally within 30 days.

After appellate decision United States Attorney’s office will reassert desirability of retrial and a decision is made to go forth with second trial and no additional appeals are filed, earliest estimates to commence jury selection would be August, 1982 with testimony commencing approximately 30 days thereafter.
