For information, the defense in captioned matter has filed “Petition for Rehearing and Suggestion for Rehearing En Banc” before the Ninth Circuit Court of Appeals, San Francisco, California.
Request in essence petitions the Court of Appeals for a rehearing before all twelve justices to provide a ruling on the previously submitted opinion concerning government submission of evidence.
Above action vacates any further trial until such time as the Ninth District Court of Appeal either rejects petition or permits rehearing and furnishes new opinion. Any trial is therefore
