On December 6, 1983, United States Court of Appeals for the Ninth Circuit denied defense petition for rehearing.

On same date, defense for Larry Layton filed a motion for stay of mandate until such time as they could appeal the Ninth Circuit opinion before the Supreme Court.

It is expected that the Ninth Circuit will grant the defense state of mandate to enable them to appeal matter before Supreme Court.

In view of the above, pending trial continues to be postponed indefinitely.
