On July 29, 1985, US Court of Appeals, 9th Circuit, upheld judge’s original ruling to exclude the “last hour tape” in the retrial of Larry Layton.
US Attorney, San Francisco, advised he will announce later this week government’s intention concerning possible retrial. It is expected that court hearing will be scheduled within 30 days to set trial date.
FBIHQ and San Juan will be kept apprised of developments.
