PURPOSE: To advise of Departmental opinion on the legality of FBI extra-territorial investigations.

RECOMMENDATION: None. For information.

DETAILS: On 11/21/78, Al Hantman, Section Chief, General Crimes Section, Criminal Division, Department of Justice, advised SA [deleted name], Criminal Investigative Division, that his research of the Congressional Assassination Statute supports the position that the FBI has extra-territorial jurisdiction in this matter. In addition, while the Congressman was not a “protected person” under diplomatic coverage, the Assistant Consular who was wounded [Richard Dwyer] was and this gives the FBI a former base for conducting this operation.
