1. Information in Reftel (A) was based on erroneous facts. PPT/LS was unaware of the full magnitude of this case.

2. Department’s (PPT/LS) general policy with respect to issuance of a passport to a child involved in a custody dispute is as follows: a passport may be issued based on the application by either parent, legal guardian or person standing in loco parentis unless the post has received a copy of a custody order from a local court awarding custody to the objecting party or a copy of a court order prohibiting the departure of the child from the country.

3. Department has been advised that even if a passport were issued to the subject, he will not be permitted to leave the country. Even though this may be the case, it is the responsibility of the Guyanese authorities to prevent the departure of the child from the country and does not prevent the issuance of a passport to him. The Embassy should not view issuance of a passport in this case as “complicity in kidnapping” since issuance would be based on the Department’s general policy in cases of this type. (See Para 2)

4. Finally, the term “anyone” in the paragraph one of the Reftel (A) was based on the power of attorney received by the Department from Timothy Stoen, who granted such authority. In the event a passport application is executed, Amembassy should contact PPT/LS before issuance.
